Terms and Conditions for Purchasing Live Plants & Trees

1. Acceptance of Terms

By proceeding with the purchase of trees from the Biomes Plant Network and our official partners you acknowledge and agree to adhere to the following terms and conditions:

You have paid for your orders in full and may be subject to some slight changes once we physically lift the trees. Remainder of order value is due for payment prior to pickup or delivery.

All prices shown on website are Freight On Board (FOB) St. Williams, Ontario. Delivery may be added to an order once you request a quote.

Guarantee:

We guarantee our stock is true to name and in good condition at time of sale. 

By purchasing through the Biomes Plant Network and through our official growing partners you fully accept the following terms of purchase:

1. Plant Care and Maintenance: a. The store is not liable for any damages or losses resulting from improper care or maintenance of the plants by the customer after the purchase. b. The store may provide general guidelines or instructions for plant care but cannot guarantee the customer's success in maintaining the plants.

2. Allergic Reactions or Health Issues: a. The store is not liable for any allergic reactions or health issues experienced by customers due to contact with or exposure to the plants purchased. b. It is the customer's responsibility to research and be aware of any potential allergies or health risks associated with specific plants.

3. Plant Growth and Survival: a. The store does not guarantee the growth, survival, or performance of the plants beyond the time of purchase. b. Factors such as environmental conditions, care practices, and natural variations can affect plant growth and survival, and the store is not liable for these outcomes.

4. Plant Characteristics: a. The store is not liable for any variations in color, size, shape, or appearance of the plants as they are living organisms and can naturally exhibit differences. b. Any descriptions, images, or representations of the plants provided by the store are approximate and may not exactly match the received plants.

5. Pests or Diseases: a. The store is not liable for any pests, insects, diseases, or pathogens that may affect the plants after purchase. b. It is the customer's responsibility to inspect the plants upon delivery and promptly address any signs of infestation or disease.

6. Force Majeure: a. The store is not liable for any delays, failures, or non-performance of its obligations due to events beyond its reasonable control, such as natural disasters, strikes, or acts of government.

Claims:

Please look over all plants upon receipt of order and notify of any claims within 1-2 days of receipt so we can best review the situation. Photos and any other details requested must be submitted within 5 days of receiving and be approved by the Biomes Plant Network and our official partner growers.

Cancellations:

Any cancellations and refunds must be made via email at least 2 days prior to your order being shipped out from our facilities.  Cancellations will not be accepted once your order has been already shipped or delivered.

Limitation of Liability:

The Biomes Plants Network and its official partners shall not be held liable for any issues arising from customer or third-party transport, installation or planting, and / or for other factors beyond our control affecting plant, shrub or tree health and growth once plants, trees or shrubs have been pickup up or shipped.
